1. Acceptance of Terms

By accessing or using Writing Nexus ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Writing Nexus is a web-based platform for planning, structuring, and writing novels. We provide tools for manuscript management, character development, timeline visualization, AI coaching, and other writing-related features.

3. User Accounts

3.1 Account Creation

  • You must be at least 13 years old to use this Service
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activity under your account
  • You must notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Abuse the Service or other users
  • Have been inactive for an extended period

4. Intellectual Property Rights

4.1 Your Content

You retain all ownership and intellectual property rights to your content. This includes your manuscripts, characters, plots, notes, and all creative work you create using our Service.

4.2 License to Us

You grant us a limited license to:

  • Store and display your content back to you
  • Process your content to provide Service features (e.g., AI coaching, exports)
  • Create backups for data security and recovery

We do NOT:

  • Claim ownership of your content
  • Use your manuscripts to train AI models
  • Share your creative work with third parties (except service providers bound by confidentiality)

4.3 Our Content

The Service itself (software, design, features, UI, question templates, etc.) is owned by Writing Nexus and protected by copyright, trademark, and other intellectual property laws.

5. Acceptable Use

You agree NOT to:

  • Use the Service for illegal activities
  • Upload content that infringes others' intellectual property
  • Upload malicious code, viruses, or malware
  • Attempt to hack, reverse engineer, or compromise the Service
  • Share your account credentials with others
  • Use the Service to harass, threaten, or harm others
  • Scrape, crawl, or systematically extract data
  • Resell or redistribute the Service
  • Create fake accounts or impersonate others

6. Subscription & Payments

6.1 Plans & Pricing

  • Current plan pricing is available at /pricing
  • We reserve the right to change prices with 30 days notice
  • Price changes do not affect active subscriptions until renewal

6.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method on each billing cycle
  • Failed payments may result in service suspension

6.3 Refunds

  • 14-Day Trial: Free trial for all new accounts
  • Monthly Plans: No refunds for partial months
  • Annual Plans: Pro-rated refunds within 30 days of purchase
  • AI Credits: Purchased credits are non-refundable

6.4 Cancellation

  • You can cancel your subscription at any time
  • Access continues until the end of your billing period
  • No refunds for unused time on monthly plans
  • Your content remains accessible after cancellation (read-only)

7. AI Credits & Usage

  • AI credits are consumed when using AI-powered features
  • Monthly credits reset at the start of each billing cycle
  • Bonus credits (from milestones) never expire
  • Unused monthly credits do not roll over
  • We reserve the right to limit AI usage to prevent abuse

8. Data & Privacy

  • See our Privacy Policy for details on data handling
  • You can export your data at any time
  • You can request deletion of your account and data
  • We use industry-standard security measures
  • We cannot guarantee 100% security (no service can)

9. Service Availability

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service
  • Planned maintenance will be announced in advance when possible
  • We are not liable for service interruptions or data loss
  • We recommend regularly exporting your manuscripts as backups

10. Disclaimers & Limitations

10.1 Service "As Is"

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be error-free, secure, or meet your specific needs.

10.2 AI Disclaimers

  • AI-generated suggestions are for inspiration only
  • We do not guarantee accuracy or quality of AI outputs
  • You are responsible for reviewing and editing all AI suggestions
  • AI may occasionally produce inappropriate content - report it immediately

10.3 Writing Disclaimers

  • We provide tools and guidance, not writing services
  • We do not guarantee your book will be published or successful
  • Story structure advice is based on common principles, not universal rules

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not liable for data loss (backup your work!)
  • We are not liable for third-party actions or content

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your content infringing others' rights
  • Your misuse of the Service

13. Changes to Terms

  • We may update these Terms from time to time
  • We will notify you of material changes via email or in-app notification
  • Continued use after changes constitutes acceptance
  • If you disagree with changes, you may cancel your account

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.
